Serious Crime
International Drugs Conspiracy
R v AA
Narita Bahra KC secure acquittals in series of international and national drugs conspiracies.
Narita’s client was indicted as the first defendant in a multi handed trial. The client was facing a custodial sentence in excess of 20 years, if convicted.
Shortly before the trial the prosecution ‘cracked’ the client’s locked digital devices. Defence disclosure requests met with opposition in the form of Public Interest Immunity applications.
Narita succeeded in excluding evidence obtained from the unlocked phones on the grounds of unfairness and prejudice to her client. Defence representations resulted in a review and the Prosecution offered no evidence against Narita’s client. The trial for all remaining co-defendants continued.
